Understand Your Legal Options

What are your options for pursuing compensation?

When you have been seriously injured in an accident, it is highly advisable to seek the help of an experienced attorney who can advise you of your legal options. Depending on the circumstances of the accident, you may have grounds to file a lawsuit or to claim disability benefits, making it possible for you to offset the significant economic impact of the accident. This may be a highly confusing-even overwhelming-situation for you, but an attorney from Morris, Cary, Andrews, Talmadge & Driggers, LLC is ready to help you find the answers you need and to guide you in making the best decisions about your case.

If Another Person Caused the Accident

One of the most important questions to answer in the wake of a car accident, slip and fall or other type of accident is, "Who is at fault?" If it can be proven that another person is responsible for causing the accident, you may be entitled to recover monetary damages by filing a personal injury or wrongful death claim. You should not be forced to pay the price for another person's negligence, and have a right to demand compensation for injuries suffered through no fault of your own. In most cases you will be filing a claim against the other party's insurance policy in pursuit of a settlement out of court. If the insurance company refuses to pay you a fair amount, we may be able to take the case to court to fight for a fair award of damages.

If You Were Injured on the Job

In the event that you have been hurt in an accident at work, you are most likely entitled to file a claim for workers' compensation benefits. Whereas a personal injury claim depends on being able to prove that the accident was caused by another person's negligence, workers' comp is a no-fault program. Provided that you were not engaged in willful misconduct at the time of the accident, you should be able to receive benefits which cover all of your medical expenses as well as wage-replacement benefits. The downside to workers' comp, however, is that it generally only pays at a rate of two-thirds of your normal wages, so you could still be facing considerable financial hardship. If another party caused-or contributed to-your accident, you could be able to file a personal injury claim instead of or along with your claim for workers' comp.

Claims for Social Security Disability

Another option which may be available to you is to file a claim for Social Security Disability benefits. SSD is available for individuals who suffer from an injury or illness which makes it impossible for them to continue in their job or to find suitable replacement employment, and which is expected to last a year or be terminal. When filing a claim for Social Security, it is important to realize that roughly two out of every three claims are initially denied, and the process of appeals can take months of longer.
